1. Scope of application, amendments

The General Terms and Conditons govern the legal relationship between the member on the one hand, and IMPACT Martial Arts AG, Josefstrasse 92, 8005 Zurich on the other (hereinafter "IMPACT").

The member acknowledges that the general terms and conditions are subject to change. The current General Terms and Conditions can be viewed at any time at www.impact-martialarts.com/terms-and-conditions.

2. Offer

IMPACT offers group trainings, personal trainings or seminars. IMPACT offers various subscriptions and services in this regard. The offers and their prices depend on the membership selected. Membership is personal and non-transferable.

3. Subscriptions "Membership 1 to 5+" and "Membership block card"

IMPACT offers the "Membership 1 to 5+" and "Membership Block Card" subscriptions. It is possible to upgrade an existing "Membership 1 to 4" subscription, whereby the difference between the subscriptions must be paid as a one-off payment.

If there is a valid reason on the part of the member (illness, pregnancy, accident, military service, business trips abroad, further training), the "Membership 1 to 5+" subscriptions can be interrupted for a period of one to three months (per contract year) with a contract term of at least six months, whereby there is no entitlement to this.

The member is not entitled to compensation or replacement hours or a refund of the amount paid if IMPACT is unable to provide its services through no fault of its own for reasons beyond its control (force majeure, epidemic, pandemic, etc.).                                                                                                                                                                            

If the services are not provided for at least one month, the contract term shall be extended accordingly.

 4. Participation in Training

a) Prerequisites

Participation in training is subject to the following requirements: 

Fitness for sport: The member is obliged to assess his/her own fitness for sport.                                                                                                                                                                                                                                                                                                       Injuries and impairments of a physical or psychological nature must be reported to the head coach at the latest before the start of training. By participating in training, the member confirms that he/she is fit for sport. 

Safety and consideration: The member shows consideration for other people and acts to the best of his/her knowledge and belief to ensure the safety of everyone. Participation in training under the influence of drugs is not permitted. Participation in training is prohibited for members with symptoms of illness, suspected infection with transmissible pathogens and/or quarantine (officially or self-imposed). The risk of infection cannot be completely ruled out even if the hygiene rules are observed. IMPACT excludes any liability in this regard.

b) Training times

 When concluding a contract for the "Membership 1 to 4" or "Membership block card" subscriptions, the member is only entitled to participate in training sessions on the agreed days of the week and at the agreed times. If a member does not take part in a training session, they are not entitled to make up the missed training session.

With the "Membership 5+" subscription, the member may take part in all training sessions in their category (gender and level) and is not tied to specific days of the week and times.

 c) Holidays and public vacations

The member acknowledges and accepts that no training sessions will take place in August in calendar weeks 31 and 32 and in December in calendar weeks 51 and 52 due to vacation absences and on public holidays in the Canton of Zurich.

5. Sound, Image and Video Recordings

The member agrees that sound, image and video recordings may be made during the training. The recordings may be used by IMPACT for internal purposes and its own marketing (website, Instagram, Facebook, TikTok, LinkedIn, etc.). 

The member may refuse audio, image or video recordings that concern them in individual cases or in general. In the event of refusal, no recordings will be made by the member or recordings already made will be deleted.

6. Information about WhatsApp groups

The member acknowledges and expressly agrees that they will receive information on training courses etc. via an IMPACT WhatsApp group. The WhatsApp groups are divided into a female and male group, whereby further groups (e.g. according to age) can be formed.

  7. Exclusion of liability

To the extent permitted by law, IMPACT accepts no liability for direct or indirect damages. The use of IMPACT's services, in particular participation in courses, is at the member's own risk and peril. The member is responsible for taking out insurance. 

IMPACT is not liable for the loss of personal effects, valuables, money, clothing, etc.

8. Instructions

The member is obliged to follow the instructions of the staff. In the event of gross or repeated violations of the staff's instructions, IMPACT is entitled to issue a house ban and terminate the contract with immediate effect. A contractual claim for repayment by the member is excluded.

9. Data Protection

The processing of personal data in connection with subscriptions to IMPACT is subject to the separate privacy policy. The privacy policy is available online, currently at www.impact-martialarts.com/datenschutzerklärung. By concluding a contract, the member accepts the associated processing of their personal data in accordance with the privacy policy.

10. Applicable law and place of jurisdiction

These terms and conditions and the subscriptions concluded hereunder are subject exclusively to substantive Swiss law, to the complete exclusion of the conflict of laws rules of private international law.

The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC and the subscriptions is Zurich, Switzerland.
